Progressive Discipline/Mitigating Factors Checklist Last Updated: 2017-01-24

Prior to determining whether or not to impose progressive discipline, particularly suspensions and expulsion recommendations, it is imperative that you document your consideration of the mitigating and other factors with respect to the student. Some boards have developed a form to assist with this task and if your board has such a form you must use it. The OPC has also prepared a form drawing not only from O. Reg. 472/07 but also decisions of the Child and Family Services Review Board (CFSRB). The CFSRB hears expulsion appeals and interprets how the mitigating and other factors should be applied in the school setting.

Ability to control behaviour
Ability to understand the foreseeable consequences of behaviour
Whether the student’s presence in the school creates an unacceptable risk to the safety of any person
Student’s history
Whether progressive discipline has been used
Relation of the discipline to harassment of student based on race, ethnic origin, religion, disability, gender, sexual orientation or other harassment
Impact on ongoing education
Age


For students with an Individual Education Plan (IEP), consider whether:

Behaviour was a manifestation of identified disability 
Appropriate individualized accommodation was provided
Suspension or expulsion is likely to aggravate or worsen behaviour or conduct


In determining whether to suspend the student and if so, the length of the suspension:

Review board policy and procedures regarding suspensions
Make the determination in accordance with board policy and procedures regarding suspensions

In conducting an investigation to determine whether to recommend to the board that the student be expelled: 

Review board policy and procedures regarding expulsions
Conduct the investigation in accordance with board policy and procedures regarding expulsions
In recommending the student’s expulsion from all schools of the board, the determination is not based on the availability of additional supports at a program for expelled students

Decision:

To impose a school sanction other than suspension
To suspend the student for ___ days
To recommend the student’s expulsion from his or her school only
To recommend the student’s expulsion from all schools of the board.
